TechCheck with Jim Goldman: Yahoo Can't Cope with Cyber Monday

Thousands of online retailers who rely on Yahoo's e-commerce systems were in a panic today, when the Internet giant's small business servers suffered an outage that the company blamed on high holiday traffic. The timing could not be worse, writes CNBC's Jim Goldman, on what has become known as "Cyber Monday," the busiest day for online shopping, which follows brick-and-mortar retails' Black Friday. 1. FCC VS. CABLE: FCC Chairman Kevin Martin thinks cable companies reached the competitive saturation point with consumers and he to tighten regulation on the cable industry with his plan for a so-called a la carte system, pushed to offer increasaed choices and decreased costs for consumers. A vote tomorrow could signal the end to the current cable business model as we know it as patrons and shareholders alike. Hampton Pearson digs in to reveal the changes in the landscape for cable companies and their shareholders.
2. NYC COUNTS CALORIES: NYC Board of Health wants calorie counts listed alongside prices on menus for all chain restaurants but the restaurants and lobbyists are pushing back. Although only 10% of total restaurants are chain restaurants the meals purchased are 30% of restaurant meals. Bertha Coombs is live at the hearing in New York with the calorie latest.
3. CONSUMER CONFIDENCE: Consumers confidence is slipping and sits at its lowest level since Hurricane Katrina, and fears of inflation are on the rise. Steve Liesman examines the data to see if the number surprise to the upside on the heels of holiday spending.
4. OSCAR WYATT SENTENCED: Houston oil tycoon Oscar Wyatt, who plead guilty to his involvement in the UN oil-for-food case is sentenced at US District Court at 2pm. Scott Cohn monitors latest.
5. CALLING COUNTRYWIDE: Countrywide management is expected to present on a 10am ET conference call as a part of the Friedman, Billings, Ramsey Capital Markets Investor Conference in New York City. Conference is invitation only and no camera presence is allowed. Jane Wells monitors via web streaming.
